These Terms of Service ("Terms") are an agreement between you and [Company Name] ("Rank", "we", "us", "our"), of [Address]. They govern your use of the Rank website, app, and related services (the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Rank
1.1 You must be at least 18 years old. By using the Service you confirm that you are 18 or older and legally able to enter into this agreement. We may close any account we reasonably believe belongs to someone under 18.
1.2 You may not use the Service if we have previously suspended or banned you, or if the law where you live prohibits it.
1.3 Accounts are for one individual. You may not share your account or create an account for someone else.
2. Your account
2.1 You can sign up with an email and password or with Google. You must give accurate information and keep it up to date.
2.2 You are responsible for keeping your login credentials secure and for everything that happens under your account. Tell us promptly at [Contact Email] if you think your account has been accessed without permission.
3. What the Service does
3.1 Rank lets you upload photos, enter a free-form prompt (for example, "best lighting"), and receive an AI-generated ranking with scores and confidence indicators ("Output").
3.2 Every ranking is saved automatically in your account, including the photos, prompt, title, and result order. We keep it until you delete the ranking or your account. You can edit or delete rankings at any time. See the Privacy Policy for details.
3.3 We may change, add, or remove features, or stop offering the Service, at any time. Where a change materially reduces what you can do, we will try to give reasonable notice.
4. Your content and your promises about it
"Your Content" means the photos you upload, the prompts you enter, and anything else you submit.
4.1 You promise (warrant) that, for every photo you upload:
- (a) you own it, or you have all rights, licences, and permissions needed to upload it and have it processed as described in these Terms;
- (b) every identifiable person in it has consented to the photo being uploaded and ranked by an AI system, and if any person in it is not you, you have their consent (and you can show it if asked);
- (c) no identifiable person in it is under 18, except where the photo is entirely non-sexual and you are that person's parent or legal guardian or have their parent's or guardian's consent; and
- (d) uploading and processing it does not break any law or infringe anyone's rights, including copyright, privacy, publicity, or data protection rights.
4.2 You keep ownership of Your Content. We do not claim ownership of your photos or prompts.
4.3 Licence to us. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, resize, and display Your Content only as needed to operate, provide, secure, and improve the reliability of the Service for you, to moderate it, and to comply with the law. This includes sending it to the third-party processors described in Section 7. This licence ends when you delete the content or your account, except for (a) copies we must keep to comply with law or a legal request (see Section 5.3), and (b) residual copies in backups that are deleted in the normal course. We do not use your photos to train AI models, and we do not sell Your Content.
4.4 You are solely responsible for Your Content and the consequences of uploading it. We do not pre-approve content and are not responsible for it, though we use automated systems to check it (Section 6).
5. Prohibited content and conduct
5.1 Zero tolerance for child sexual abuse material (CSAM). You must never upload, or attempt to upload, any image that sexualizes a minor in any way, including CSAM, sexualized images of anyone who is or appears to be under 18, and AI-generated, drawn, or edited images of that kind. We will immediately terminate the account and report it to the National Center for Missing & Exploited Children (NCMEC) and/or other law enforcement authorities as required or permitted by law.
5.2 You must not upload, submit, or use the Service for:
- (a) nudity or sexual content of any kind, including sexually suggestive images;
- (b) non-consensual images: photos of anyone who has not agreed to their image being uploaded and ranked, intimate images shared without consent, hidden-camera or "creepshot" images, or images obtained by hacking or deception;
- (c) ranking people to demean, mock, or harass them, including prompts such as "ugliest", "fattest", or "least attractive", or rankings intended to shame, bully, or humiliate anyone;
- (d) ranking or categorizing people by race, ethnicity, religion, disability, sexual orientation, gender identity, health, or other protected characteristics, or for discriminatory purposes;
- (e) making decisions about employment, housing, credit, insurance, education, immigration, law enforcement, or access to services, or any other decision with legal or similarly significant effects on a person;
- (f) identifying, tracking, profiling, or surveilling people, including facial recognition or attempts to work out who someone is;
- (g) harassment, threats, hate speech, or content that promotes violence, self-harm, or terrorism;
- (h) graphic violence, gore, or animal cruelty;
- (i) illegal content or content that infringes anyone's intellectual property, privacy, or publicity rights;
- (j) content containing other people's personal data (such as ID documents) that you have no right to share; or
- (k) anything else that, in our reasonable judgment, is harmful, abusive, or objectionable.
5.3 You must not:
- (a) attempt to bypass, disable, or probe our moderation, rate limits, or security measures, including by rewording prompts to evade filters;
- (b) access the Service by automated means (bots, scrapers) except through interfaces we provide for that purpose;
- (c) reverse engineer, decompile, or copy the Service, or use it or its Output to build a competing product or train AI models;
- (d) overload, disrupt, or interfere with the Service or its infrastructure;
- (e) introduce malware or attempt unauthorized access to any account, system, or data;
- (f) resell, sublicense, or provide the Service to third parties without our written permission; or
- (g) violate the acceptable use policies of our AI providers, which apply to content processed through them.
5.4 Reporting and preservation. Where the law requires or allows it, we may preserve Your Content and account information and share it with NCMEC, law enforcement, or other authorities, even if you have deleted it.
6. Moderation
6.1 Prompts and uploads are checked automatically, in real time, by our own and third-party moderation systems. Content that is flagged may be blocked without explanation.
6.2 Automated moderation is imperfect. It may block acceptable content or miss prohibited content. A blocked or allowed item does not mean we have approved or reviewed it, and you remain responsible for complying with Section 5 whatever the filters do.
6.3 We are not obliged to monitor the Service, but we may review, block, or remove any content and take action on any account at our discretion, consistent with applicable law.
7. AI Output and third-party AI processors
7.1 Output is for entertainment and general informational purposes only. Rankings, scores, and confidence values are generated by a third-party AI model and:
- may be inaccurate, inconsistent, or arbitrary; the same photos and prompt may produce different results;
- may reflect biases present in the model, including biases relating to appearance, age, gender, skin tone, or culture;
- are not a judgment of anyone's worth, attractiveness, character, or abilities, and are not professional, psychological, medical, or other advice; and
- are not reviewed by a human.
7.2 Do not rely on Output for any important decision, and do not use it in any way prohibited by Section 5. You use Output at your own risk.
7.3 Subject to these Terms, you may use the Output for your own personal purposes. We make no claim that Output is unique or that it is protectable by copyright.
7.4 Third-party processors. To provide the Service, Your Content is processed by third parties, including our hosting provider (Cloudflare), an AI routing service (OpenRouter) and the model provider(s) it routes to, and moderation providers. We request zero data retention and no training from AI providers where those options are available, but we do not control these third parties and are not responsible for their acts or omissions. See the Privacy Policy for the current list.
8. Fees and future paid plans
8.1 The Service is currently free.
8.2 We may introduce paid plans, usage limits, or premium features in future. If we do, we will tell you the price and terms before you are charged, and paid features will be subject to additional terms you accept at purchase. We will not charge you without your explicit agreement. Unless the law requires otherwise or the additional terms say so, fees are non-refundable.
8.3 We may set and change usage limits (such as the number of photos per ranking or rankings per day) at any time.
9. Intellectual property
9.1 The Service, including its software, design, branding, and content (excluding Your Content and Output), is owned by us or our licensors and protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service in line with these Terms. All other rights are reserved.
9.2 If you send us feedback or suggestions, we may use them freely without any obligation to you.
10. Copyright complaints (DMCA) and other reports
10.1 We respect intellectual property rights and respond to valid notices under the U.S. Digital Millennium Copyright Act (DMCA) and similar laws.
10.2 To report infringement, send a notice to our designated agent at [DMCA/Legal Contact Email] or [Address], including:
- (a) your physical or electronic signature;
- (b) identification of the copyrighted work you claim is infringed;
- (c) identification of the material you claim is infringing, with enough information for us to locate it;
- (d) your name, address, telephone number, and email address;
- (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
10.3 Counter-notices. If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the same address including: your signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address, and phone number; and your consent to the jurisdiction of the federal court for your district (or, if outside the U.S., any judicial district where we may be found) and to accept service from the person who sent the original notice.
10.4 We will terminate, in appropriate circumstances, the accounts of repeat infringers.
10.5 Other reports. To report a photo of you uploaded without your consent, suspected child exploitation, or any other violation of these Terms, contact [Abuse/Report Contact Email]. Because Rank has no sharing or public pages, content is visible only to the account holder; please include as much detail as you can (for example, the email of the account involved, if known). If you believe a child is in immediate danger, contact your local police first. In the U.S., you can also report child exploitation directly to NCMEC at CyberTipline.org.
11. Suspension and termination
11.1 By you. You can stop using the Service at any time and delete your account from the Account page. Deleting your account permanently deletes your rankings and account data as described in the Privacy Policy.
11.2 By us. We may suspend or terminate your access, block or remove any of Your Content, or delete your account, at any time and without prior notice, if: we reasonably believe you have broken these Terms or the law; it is needed to protect users, third parties, or us; we are required to by law or a public authority; or we stop offering the Service. Where reasonable and lawful, we will tell you why. For violations of Section 5.1, termination is immediate and permanent.
11.3 On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including 4.1, 4.4, 5.4, 7, 9, 12 to 18) will survive.
12. Disclaimer of warranties
12.1 THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and those arising from course of dealing or usage of trade.
12.2 We do not warrant that the Service will be uninterrupted, secure, or error-free; that Output will be accurate, reliable, unbiased, or suitable for any purpose; that moderation will catch all prohibited content; or that any content will be preserved. You are responsible for keeping your own copies of your photos.
12.3 Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
13. Limitation of liability
13.1 TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPUTATION, OR FOR EMOTIONAL DISTRESS, arising out of or relating to these Terms, the Service, Output, or Your Content, whatever the legal theory and even if we were advised of the possibility.
13.2 OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
13.3 These limits apply even if a remedy fails of its essential purpose. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence, or your statutory rights as a consumer.
14. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, employees, and agents from and against all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) Your Content, including any claim that it infringes or violates a third party's rights (including privacy, publicity, or consent); (b) your use of the Service or Output; (c) your breach of these Terms or any warranty you give in them; or (d) your violation of any law or third-party right. We may take control of the defence of any such claim at your expense, and you will cooperate with us. You may not settle any claim affecting us without our written consent.
15. Changes to these Terms
We may update these Terms from time to time. We will post the new version with a new "Last updated" date. For material changes we will give reasonable advance notice (for example, by email or in the app) before they take effect. If you keep using the Service after changes take effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
16. Governing law and venue
These Terms and any dispute arising from them are governed by the laws of [Governing Law/Jurisdiction], without regard to conflict-of-laws rules. Subject to Section 17 (if included), the courts of [Venue/Courts] have exclusive jurisdiction, and you and we consent to their jurisdiction. If you are a consumer, you may also have the benefit of mandatory protections of the law of the country where you live, and you may be able to bring proceedings in your local courts.
17. Dispute resolution, arbitration, and class-action waiver (Optional)
Note for review: arbitration and class-action waivers are generally enforceable against U.S. consumers (subject to rules on notice, fairness, and opt-out) but are restricted or unenforceable against consumers in many other countries, including the EU and UK. Decide with a lawyer whether to include this section, and whether to limit it to U.S. users.
17.1 Informal resolution first. Before starting any formal proceeding, you agree to contact us at [Contact Email] with a description of the dispute and try in good faith to resolve it for at least 30 days.
17.2 Binding arbitration. If the dispute is not resolved, it will be settled by binding individual arbitration administered by [Arbitration Provider, e.g. the American Arbitration Association under its Consumer Arbitration Rules], seated in [Arbitration Seat]. The arbitrator's decision is final and may be entered in any court with jurisdiction. Either party may instead bring an individual claim in small-claims court if it qualifies, and either party may seek an injunction in court to protect intellectual property rights.
17.3 Class-action waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.
17.4 Opt-out. You may opt out of this Section 17 by emailing [Contact Email] within 30 days of first accepting these Terms, stating your name, account email, and that you opt out of arbitration.
17.5 If the class-action waiver is found unenforceable for any claim, that claim will be decided in court under Section 16, not in arbitration.
18. General
18.1 Entire agreement. These Terms, together with the Privacy Policy and any additional terms you accept for specific features, are the entire agreement between you and us about the Service and replace any prior agreements.
18.2 Severability. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms will remain in full effect.
18.3 No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
18.4 Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer ours in connection with a merger, acquisition, reorganization, or sale of assets, or to an entity we set up to operate the Service.
18.5 No third-party beneficiaries. These Terms do not give rights to anyone other than you and us.
18.6 Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of our hosting, AI, or moderation providers.
18.7 Notices. We may send notices to the email address on your account or through the Service. You can send notices to [Contact Email] or [Address].
18.8 Language. If we provide a translation, the English version controls to the extent permitted by law.
